Scope
  • Intermediary service providers (ISP) offering services to the recipients of the service that have their place of establishment or are located in the EU. ISPs include:

  • Internet access providers

  • Hosting services

  • Search engines

  • Online marketplaces

  • Social networks

  • Online platforms, including Very Large Online Platforms (VLOPs) and Very Large Online Search Engines (VLOSEs) used by more than 10% of the 450 million consumers in the EU

  • Relevant provisions: Article 2Article 33

  • Obligation to have a designated point of contact for authorities and user (Article 11Article 12)
  • Requirement to ensure terms and conditions are fair and clear (Article 14)
  • Mandatory transparency reports detailing content moderation practices and outcomes (Article 15)
  • Implementation of notice and action mechanisms to handle illegal content on platforms (Article 16)
  • Provision of clear information regarding online advertising, including advertiser identity and parameters used in personalisation (Article 39)
  • Note that DSA imposes different obligations based on the type, nature, and size of the digital services provided
