Data Act - Commission seeks feedback on draft Guidelines for reasonable compensation

The draft guidelines provide good-practice guidance on the parameters relevant to determining, assessing, or calculating reasonable compensation under Article 9 of the Data Act, which governs a data holder's right to request compensation from data recipients for enabling data access and use. They address the preferential treatment granted to micro, small, and medium-sized enterprises and non-profit research organisations under Article 9(4), which limits how compensation may be calculated for these categories, and clarify the distinct cost elements that may be included in a compensation calculation.
