The statement sets out the EDPB's preliminary reflections on processing personal data through smart glasses, defined as wearable devices resembling ordinary eyewear that include cameras, microphones, speakers and software, including AI systems. It covers controllership, transparency towards bystanders and legal basis. It also covers technical measures such as LED and audio indicators, data minimisation and storage disabled by default. With respect to ePD, the statement notes that in some circumstances smart glasses may be regarded as terminal equipment to which the ePrivacy framework may apply. This is specifically the case where embedded sensors collect, locally store and process information such as images, videos or sound, or where that information is by default made available to a remote server, such as a social network profile or a webpage. In this respect it refers to the EDPB Guidelines 2/2023 on the technical scope of Article 5(3) of the ePrivacy Directive.
